Navi Mumbai, October 13, 2026: The Bombay High Court has delivered significant relief to two older cooperative housing societies in Navi Mumbai, ruling that CIDCO cannot impose transfer charges when the original land lease agreements do not contain provisions requiring such payments.

The judgment, delivered by a division bench of Justices Bharati Dangre and Manjusha Deshpande on September 29, 2026, concerns housing societies whose lease deeds were executed before February 8, 1990.

Why Did the Case Arise? Pre1990 Navi Mumbai Housing Societies Get Relief from CIDCO Transfer Charges Bombay High Court

The dispute began when the City and Industrial Development Corporation (CIDCO) demanded ₹24.58 lakh from Manmandir Cooperative Housing Society in Nerul for the transfer of 27 flats. The society challenged the demand, arguing that its original agreements did not require flat owners to pay transfer charges.

The petition also involved Surya Cooperative Housing Society in Vashi and the Navi Mumbai Cooperative Housing Federation.

What Did the Bombay High Court Rule?

The court held that the regulatory amendment introduced on February 8, 1990, could not be applied retrospectively to impose new financial obligations that were absent from the original lease agreements.

As a result, CIDCO's transfer-charge demands against Manmandir and Surya societies were set aside. The court rejected the argument that the amendment merely clarified existing regulations, observing that it introduced a substantive requirement for approval and payment.

Will All Pre-1990 Housing Societies Benefit?

Although the judgment offers hope to other older housing societies, the relief is not automatically applicable to all societies in Navi Mumbai.

The court declined to extend the same relief to the federation's other 2,528 member societies because the relevant lease documents and details were not available on record.

Therefore, societies seeking similar relief must examine their original allotment letters, agreements and lease deeds to determine whether CIDCO transfer charges were included in their contractual terms, Pre1990 Navi Mumbai Housing Societies Get Relief from CIDCO Transfer Charges Bombay High Court.

What This Means for Navi Mumbai Property Owners

The ruling could become important for property owners and cooperative housing societies dealing with CIDCO transfer charges. It reinforces the principle that new financial obligations cannot automatically be imposed retrospectively when they were absent from the original agreements.

However, individual societies should verify their legal documents and seek appropriate legal advice before assuming they are exempt from transfer charges.
